About these terms
These Terms of Service govern your use of Crate Ship Games at crateshipgames.com, including the game arcade, the Crate Engine editor, accounts and the creator program (together, the “service”). The service is operated by Jamaine Martin, Washington, United States (“Crate Ship Games”, “we”, “us”). By using the service you agree to these terms, the Privacy Notice, the Acceptable Use Policy and the Community Guidelines. Questions: crateshipstudios@gmail.com.
Accounts and eligibility
You must be at least 13 years old to create an account. If you are under 18, or under the age of majority where you live, you may use the service only with the permission of a parent or guardian who agrees to these terms. The service is not directed to children under 13. Provide accurate account information, keep your sign-in secure, and tell us promptly about unauthorized access. Do not impersonate others or share an account to evade restrictions. Creators who sell games or receive payouts must be adults who can enter contracts and must complete the payment provider’s verification.
Playing games
Each game listing shows its developer, supported devices and whether it is free, free with ads, or paid. CrateShip Originals are made by us. Partner games are made by other studios, distributed by GameMonetize, and run from GameMonetize’s servers; they may show ads managed by GameMonetize, and their own terms and privacy policies apply in addition to ours. Game progress for partner games is managed by the game, not by your Crate Ship Games account. Virtual rewards, points and wallet items have no cash value, cannot be exchanged for money and are not an investment.
Buying games
Paid game sales are not open yet. When they open, each listing will show the price, what you receive, delivery format, license terms and refund rights before checkout, and the Refund & Cancellation Policy will apply. Payments will be processed by Stripe; we do not store full card numbers. A free demo is a limited version and does not include ownership of the full game.
Licenses and ownership
Crate Ship Games and its licensors own the service, the Crate Engine, CrateShip Originals and the site’s design and content. Creators keep ownership of their games and assets. You receive a personal, non-exclusive, non-transferable license to use the service and to play games as permitted by each game’s license; this does not transfer copyright. Do not copy, resell, redistribute, reverse engineer or bypass access controls except where the law allows it. Projects you build with the Crate Engine are yours, subject to the licenses of any assets or code you include. Open-source and third-party licenses continue to apply.
Your content
You keep ownership of content you upload, such as projects, games, profile information and reports. You grant us a non-exclusive, worldwide license to host, store, reproduce, adapt for technical purposes and display that content as needed to operate and provide the service to you and, for content you choose to publish, to other users. Creator listings are additionally covered by the Creator Agreement. You are responsible for having the rights to everything you upload.
Safe use and moderation
Follow the Acceptable Use Policy and Community Guidelines. We may remove content, restrict features, or suspend or close accounts to protect users, comply with law, or address violations. Where appropriate we explain the decision, and you can appeal by email to crateshipstudios@gmail.com. Urgent safety action may come first. Removing a listing does not take away consumer rights or legitimately earned amounts.
Availability and disclaimers
We work to keep the service running, but games and features may contain bugs, change, or become unavailable. Keep your own backups of projects you care about. To the extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We are not responsible for partner games or third-party websites, which are provided by their own operators.
Limitation of liability
To the extent permitted by law, Crate Ship Games is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the service. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim and fifty US dollars (US$50). Nothing in these terms excludes or limits liability or consumer rights that cannot be excluded or limited under applicable law.
Changes, disputes and ending use
You may stop using the service at any time and can delete your account in Settings. We may update these terms; we will post the new version here with its effective date and, for material changes, give reasonable notice before they apply. Changes do not alter a signed creator agreement retroactively. If you have a dispute, please contact us first so we can try to resolve it. These terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law rules, and do not require arbitration or remove any right you have under the mandatory consumer law of where you live.
